This document outlines the terms and conditions of the selling of the products listed on our website: www.foreverontrend.co.uk. Please read these terms and conditions carefully before ordering any products from our site.

Using this website indicates that you accept these terms and conditions, along with our Privacy Policy. By using these services you are agreeing to the terms and conditions which are subject to change and alterations periodically. Please check our terms and conditions on a regular basis to ensure you are aware of any changes made. Our terms and conditions are in accordance with the laws of England and all disputes will be settled in the English court system.

PLEASE NOTE THIS ADDRESS IS NOT THE RETURNS ADDRESS AND A PRIVATE RESIDENCE AND NO COLD CALLERS/PHOTOGRAPHY OPPORTUNITIES ARE PERMITTED. Any break in these rules will be dealt with accordingly.

2. PROHIBITIONS

2.1 When using www.foreverontrend.co.uk you must not misuse the website – any committals against the site which include spam and technological interferences would constitute a criminal offence under the ‘Computer Misuse Act 1990.’ We will report all breaches of www.foreverontrend.co.uk to law enforcement authorities and disclose your identity.

3.1 All software and content made available to you from www.foreverontrend.co.uk remains the property of Forever On Trend and are protected by UK copyright laws. You are under no circumstances permitted to publish, manipulate, distribute or otherwise reproduce in any form the content from.

3.2 You may use the link of www.foreverontrend.co.uk if done so in a positive, fair, legal manner which doesn’t damage our reputation. We reserve the right to withdraw and refuse linking permission without notice.

 

4. TERMS OF SALE

4.1 By placing an order through www.foreverontrend.co.uk you are offering to purchase a product on and subject to these terms and conditions. We are entitled to refuse an order made by you at any time, for any reason.

4.2 By placing and paying for an order on www.foreverontrend.co.uk and upon receiving confirmation from us you enter a binding contract upon these terms and conditions and confirm that you are legally able to do so

4.3 All orders placed through www.foreverontrend.co.uk are subject to availability and confirmation of the order price.

4.4 We will always try to honor the dispatch times shown on our website. There may however be delays (such as adverse weather conditions) and we would ask that you do not contact our customer services until the day after delivery was expected. We will make every effort to contact you as soon as we are aware of any delays.

4.5 In order to submit an order on www.foreverontrend.co.uk you must be over the age of 18 and hold a credit or debit card of a bank account acceptable to us – please see Payment (Point Six.)

4.6 When placing an order on www.foreverontrend.co.uk you undertake that all details provided are true and accurate, you are the owner of the payment card and have sufficient funds to cover the cost and delivery of the product.

4.7 When you place an order, you will receive an acknowledgement email to confirm the receipt of your order – this is the acknowledgment and is not the confirmation or acceptable email. The confirmation email comes when your goods have been dispatched – this is when you enter a binding contract with us.

4.8 We only accept orders from England, Scotland, Wales, Ireland and Northern Ireland.

5. PRICES

5.1 Where applicable, prices on www.foreverontrend.co.uk are inclusive of UK VAT rates but exclusive of delivery costs which are an addition – please see our Delivery Policy.

5.2 Prices on www.foreverontrend.co.uk are subject to change without notice but placed orders will remain unaffected.

5.3 If there has been an incorrectly priced product on www.foreverontrend.co.uk we will contact you in the first instance about this mistake. We are under no obligation to provide the product at the incorrect price.

6. PAYMENT

6.1 All orders placed on www.foreverontrend.co.uk must be paid for with a debit or credit card from a bank acceptable to us – the list of payment types we take are the following – Visa, Visa Debit, Mastercard, Solo, Maestro, Electron and Paypal.

6.2 Upon receiving the order we will carry out a standard pre-authorisation check on the card to ensure you have the sufficient funds to make the purchase. The goods will then be dispatched if authorisation was given and your card will be debited.

7. RETURNS POLICY

7.1 All orders placed on www.foreverontrend.co.uk are subject to a 14 day returns policy except in the case of receiving damaged or faulty goods, postage costs may be deducted from your refund. 

7.2 Standard delivery will be refunded upon full return, all other shipping fees will be charged upon full return

8. COMPLAINTS

8.1 We have a complaints handling procedure which we will resolve any disputes – please let us know your complaints and comments at hello@foreverontrend.co.uk. Although we aim to offer you the best service possible we may not always be able to meet your requirements. If a fault occurs please contact us and we will attempt to correct the it as soon as we reasonably can.

9. INDEMNITY

9.1 By using www.foreverontrend.co.uk you agree to indemnify and defend the employees and associates of Forever On Trend from all third party claims, liability, damages and costs arising from using www.foreverontrend.co.uk or breaching terms and conditions.

10. GOVERNING LAW AND JURISTICTION

10.1 Our terms and conditions are in accordance with the laws of England and all disputes will be settled in the English court system.

11. INTELLECTUAL PROPERTY RIGHTS

11.1 All and any Intellectual Property Rights in connection with the products and our website shall be owned by us absolutely.

PLEASE NOTE:- All customer returns are delivered to the warehouse after 2pm the following day.

PLEASE NOTE:- THAT IT IS THE CUSTOMERS RESPONSIBILITY SHOULD THEY CHOOSE TO SEND THERE GARMENTS BACK TO US ON A SATURDAY, THESE PARCELS WILL GET MISLAID AS OUR PREMISES ARE CLOSED THEREFORE NONE OF THE STAFF AT THE WAREHOUSE WILL BE THERE TO SIGN FOR YOUR RETURN AND WILL NOT BE LIABLE SHOULD SOMEONE ELSE FROM A DIFFERENT COMPANY SIGN FOR IT, WE WILL NOT TAKE RESPONSIBILITY FOR THIS.

RETURN POLICY

 

Forever On Trend - Returns & Exchange Policy

Returns of items

Please follow the steps below to return your item, unless the item is faulty or damaged this should be done within 14 days from the date of delivery. In the event of a query please contact hello@foreverontrend.co.uk

  1. Ensure the item is appropriately packed to ensure no damage occurs in transit.
  2. We would suggest that items are sent by a recorded service, if this is not possible you should obtain proof of purchase from a Post Office.  Please ensure the correct postage is paid prior to returning the item.
  3. Unless the item is damaged or faulty the customer is responsible for the returns costs.
  4. Please note: Sale items will not be accepted back for refunds/ exchanges

 

Important infomation: If you are needing to return an item to us in the 14 working day period then there is no need to email us. Simply place your return into a bubble wrapped envelope and put a note inside with the following details                                                                - Order ID Number. - Contact Telephone Number - Full Name - Reason For Return - And any other infomation we may need.                                                                                                                                                                                                                                   Then place return it the follow address below.

Terms and Conditions of Returns & Exchanges

Please read these terms and conditions to ensure your returned item does not get refused and is processed as quickly as possible. If you have a query please contact hello@foreverontrend.co.uk and we will respond as soon as possible.

  1. If products are not returned in an “as delivered” state (i.e. tags removed, make-up marks etc.) the return may not be accepted, or a charge may be levied to cover our additional costs.
  2. Due to hygiene restrictions we cannot accept returns for tanning products or eye lashes. Swimwear and bikini items will only be accepted if the hygiene strips are clearly in place and have not been tampered with.
  3. If a return is refused we will send the items back to you, however this will be at your own cost.
  4. Refunds will be processed within 30 days of being notified of the return.  Exchanges will take up to fourteen days.
  5. If we are unable to exchange an item then we will offer a refund as per the procedures herewith.
  6. If an item is delivered to you damaged or faulty we will refund the item, delivery to you and the return postage. We would ask that all faulty returns are sent by recorded post and that you email us a copy of your receipt for reimbursement.
  7. We only accept exchanges on an item once. Except in exceptional circumstances these exchanges must be on the same product but a different size or colour can be requested.
  8. We cannot “mix and match” any two piece garments such as swimwear. Refunds and exchanges will only be given on return or the complete set.
  9. If an item is not received by us and you do not have proof of postage then we reserve the right to make you responsible for the original order value.
  10. All perfumes that are returned MUST have the seal UNBROKEN and the box in a resellable condition. We CANNOT ACCEPT a return of the perfume if the SEAL HAS BEEN BROKEN.
  11. All MAKEUP Items can only be returned if they are unopened, unused and in a re-saleable condition with all tamper resistant seals, packaging and any cellophane intact and unopened.
    Items must be returned within 14 days of despatch.
     
  12. The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give consumers the right to cancel contracts concluded at a distance at any time in the cancellation period (14 days after the day on which the goods come into the physical possession of the consumer) without incurring any liability (Sections 29 - 30). Section 35 provides that the consumer must send off the goods, or hand them over, without undue delay and in any event not later than 14 days after the day on which the consumer informs the trader of his/her decision to return the goods.

    Restricting the consumer's right to exercise his/her statutory 14 day cancellation right -  by stating that if the returned goods are delivered at the merchant's office on a Saturday, the customer is liable for them being misplaced/getting lost - is contrary to the Unfair Terms in Consumer Contracts Regulations 1999 (UTCCR).

    Section 5 of the UTCCR provides that a contractual term which has not been individually negotiated shall be regarded as unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties’ rights and obligations arising under the contract, to the detriment of the consumer. Pursuant to Section 6 of the UTCCR, the unfairness of a contractual term shall be assessed, taking into account the nature of the goods or services for which the contract was concluded and by referring, at the time of conclusion of the contract, to all the circumstances attending the conclusion of the contract and to all the other terms of the contract or of another contract on which it is dependent.

    As the stronger party in the contractual relationship, Forever On Trend has a duty to organise its business so that returns can be accepted also on a Saturday/ arrange with the post office so that goods aren't delivered on a Saturday /are not left with neighbours, but that Forever On Trend can pick them up at the post office on Monday, for instance.

    Section 8 of the UTCCR provides that unfair terms in contracts concluded with consumers by sellers or suppliers shall not be binding on the consumers. As a result, Forever On Trend can't refuse refunding the consumer for goods that are delivered on a Saturday within the statutory 14 day cancellation period and get misplaced.  

     
  13. Delivery Policy

PLEASE NOTE:- Some parts of SCOTLAND and ALL of IRELAND including (ROI) are NOT available for next day delivery and will be on a 2 day delivery process. This is not part of our intended policy however it is part of the DPD delivery service that we use.

Our deliveries are normally made by DPD or one of our other delivery partners. We will always try to honour the delivery dates shown on our website, however in unusual circumstances there may be a delay. We will always try to contact you as soon as we are aware of any delays that may affect your order.

Many of our orders will require a signature on delivery. If no one is available at the delivery address it may be left with a neighbour. A card will be left to advise this, or to confirm the parcel has been returned to a local depot. You can then contact the courier directly to arrange a convenient re-delivery.

Normal delivery times are two to four working days from the date the order was placed. We offer a next day tracked delivery service Monday to Thursday for orders placed before 13.00 at an additional charge. We cannot guarantee that orders placed between Friday and Sunday will arrive on the next day due to our own and DPD working hours. Please note bank holidays are not counted as a “working day”.

Unfortunately we are currently unable to post internationally although we hope to post worldwide shortly – keep checking so you don’t miss any of our great styles or accessories!
